Terms of Service
These Terms of Service ("Terms") govern your access to and use of Colder ("the Service"), operated by Colder ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms.
Acceptance of Terms
By accessing or using Colder, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Service. You must be at least 18 years old and legally able to enter into a binding contract to use Colder.
Service Description
Colder is an AI-powered cold email outreach platform that helps consultants, coaches, and B2B sellers run personalized email campaigns at scale. Features include:
- Prospect list management and CSV import
- AI-generated personalized email drafts
- Automated multi-step follow-up sequences
- Unified reply inbox and engagement tracking
- Lead discovery and email enrichment tools
The Service is offered as a monthly subscription at $29/month, billed via Stripe. Continued use of the Service constitutes acceptance of the then-current pricing.
Acceptable Use
You are solely responsible for the prospect lists you upload and the emails you send through Colder. You agree to:
- Comply with all applicable anti-spam laws, including the CAN-SPAM Act (US), CASL (Canada), GDPR (EU/UK), and equivalent regulations in every jurisdiction where your recipients reside.
- Only email recipients with whom you have a legitimate business relationship, who have opted in, or whose contact you've sourced in compliance with applicable law.
- Include accurate sender identification and a working unsubscribe mechanism in every email. Colder automatically appends a CAN-SPAM/CASL compliance footer with sender name, company, physical address, and a one-click unsubscribe link. You must not remove or alter that footer.
- Honor unsubscribe requests promptly and stop contacting recipients who opt out.
- Refrain from sending deceptive content, phishing, malware, or any content that violates applicable law.
You may not use Colder to send unsolicited bulk email to recipients who have not given you permission, or for any unlawful, harmful, or abusive purpose. We may suspend or terminate accounts that violate these rules.
Account, Billing, and Cancellation
Account
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at colder@polsia.app if you suspect any unauthorized access.
Billing
Subscriptions are billed monthly in advance through Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel. Pricing is as listed on our Pricing page at the time of signup.
Cancellation
You may cancel your subscription at any time from your Settings page. Cancellation takes effect at the end of your current billing period — you retain access until then, and we do not issue prorated refunds for partial months.
Suspension and Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in unlawful activity, or pose a risk to other users, recipients, or the Service. Where practicable, we will give you advance notice and an opportunity to address the issue. For self-serve account deletion at any time, see our Privacy Policy.
Intellectual Property
The Service, including its design, code, branding, and AI-generated outputs produced for your account, is owned by Colder or our licensors. You retain ownership of your prospect data and the underlying content of the emails you send. You grant us a limited license to process your prospect data and email content solely to operate the Service on your behalf.
Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will achieve any specific deliverability or response rate.
To the maximum extent permitted by law, Colder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total aggregate liability for any claim arising under these Terms shall not exceed the total fees you paid us in the twelve months preceding the claim.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. For significant changes, we will notify you via email or a prominent notice in the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
